Put simply, he believes that lawyers should be accessible to their clients. He understands that folks don’t typically call when they’re having a “good day,” and it’s his job to put their fears to rest and protect them, as an ally should. What Is a Personal Injury Lawsuit?
What’s involved?
A personal injury claim arises when a victim becomes injured because of another party’s negligent, reckless, or intentional conduct. There are many ways a victim can be injured by another person’s negligence. For example, when a driver texts while driving and causes an accident, the victim can pursue a claim against the negligent driver. Similarly, when victims are injured by a dangerous condition on another person’s property, they can seek compensation from the property owner or manager. To succeed in a personal injury claim, a plaintiff must prove the four elements of negligence:
Duty
The party who caused your injury owed you a duty to act reasonably, as an ordinary person would under the circumstances.
Breach
The party who caused your injuries breached this duty by failing to act responsibly.
Causation
The party’s actions or inaction caused the accident that resulted in your injuries.
Damages
You were directly injured or harmed due to the defendant’s actions.
Damages Available in a Personal Injury Lawsuit
Personal injury victims frequently struggle to pay for medical care and rehabilitation. Many victims must take time off from work to recover. Those who suffer serious injuries may become disabled and unable to work in the future. When you work with Reed Firm, you will benefit from our proven track record of obtaining millions of dollars in compensation for personal injury victims in Arkansas.
Personal injury victims can pursue several different types of damages. Economic damages include damages that are easy to quantify monetarily, such as past and future medical expenses, property damages, and other tangible losses. Non-economic damages are also available and include pain, suffering, and mental anguish.
When there is proof that the defendant acted willfully, wantonly, or maliciously, the victim may be entitled to punitive damages in addition to economic and non-economic damages. For example, if a drunk driver caused your injuries, punitive damages may be available in your case.
